An affidavit is a formal statement put into writing signed by the person who swears to the truthfulness of the contents (affiant). These are usually signed in front of a notary public who verifies the identity of the person signing the affidavit. Some affidavits are recorded at the County Recorder’s office. Other affidavits are used in court in lieu of oral testimony or to obtain a declaration for other specific purposes. A deed is a legal document frequently used to formally transfer ownership of real estate. It can add new owners or remove old owners or do both. Sometimes it is prepared to update or correct an owner’s name, the legal description of the real property or change the type of interest the owners have in the property. Eviction is the legal process of removing a tenant from the premises, usually because of non-payment of rent or a breach of the lease. It is commonly referred to as an unlawful detainer action. If the 5th day falls on a Saturday, Sunday or a court holiday then you have until the next court day to have your response filed. A letter or phone call will not protect you. Your written response must be in proper legal form if you want the court to accept your response. We can usually have your response prepared the same day you come into our office.
